GENERAL PROVISIONS
The online store available at www.greenspot.pl is run by Greenspot Kamil Karcz with its registered office in Wadowice, ul. Polna 4, NIP number 5512612743 (taxpayer identification number), a company operating on the basis of an entry in the Central Register and Information on Economic Activity kept by the Minister of Economy.
These regulations apply to contracts concluded via the website www.greenspot.pl
Definitions:
Online Store – the Seller’s online store available at www.greenspot.pl
Regulations – these regulations of the Online Store referred to in art. 8 of the Act of July 18th, 2002 on the provision of electronic services (Journal of Laws 2002 No. 144, item 1204 as amended);
Seller – Greenspot Kamil Karcz with its registered office in Wadowice, ul. Polna 4, NIP number 5512612743 (taxpayer identification number), a company operating on the basis of an entry in the Central Register and Information on Economic Activity kept by the Minister of Economy;
Buyer – a natural person with full legal capacity, and in cases provided for by generally applicable regulations also a natural person with limited legal capacity, a natural person running a business, a legal person or an organizational unit without legal personality that uses the services provided electronically by the Seller;
Registration form – a form available in the Online Store that allows you to create an Account;
Account – a set of resources in the Seller’s ICT system, marked with an individual name (login) and password provided by the Buyer, in which the Buyer’s data is collected, including information about placed Orders;
Order form – a form available in the Online Store that allows the Buyer to place an Order and its implementation without the need to create an Account;
Order – Buyer’s declaration of will, constituting an offer to conclude a Product sales agreement (Product sales contract) with the Seller;
Sales contract – a contract for the sale of a Product within the meaning of the Civil Code (Journal of Laws 1964 No. 16, item 93, as amended), concluded via the Online Store in Polish language;
Product – a movable item available in the Online Store, which is the subject of a sales contract between the Buyer and the Seller;
Basket – a virtual tool that allows the Buyer to aggregate selected Products before their purchase and convert their value. When selecting Products, the Buyer may freely manage the contents of the basket by adding additional Products to it or removing them from the basket;
Promotion – a specific discount on selected Products, which are the subject of the sales contract between the Buyer and the Seller, strictly defined in time;
Proof of purchase – a receipt, invoice or other document confirming the purchase of the Product;
PayU Payments – the operator of the Payments service that guarantees the security of the transferred funds is PayU S.A. with the registered office in Poznan, 60-166 Poznan, at ul. Grunwaldzka 182, having the status of domestic payment institution supervised by the Polish Financial Supervision Authority, entered into the Register of Payment Services under number IP1/2012;
The services provided electronically by the Seller consist of:
a) enabling the keeping of an account in the Online Store,
b) enabling the conclusion of a Sales Agreement by completing the Order Form,
Filling out the Registration Form and creating an Account is tantamount to familiarizing the Buyer with the content of the Regulations and its acceptance.
The contract for maintaining an Account in the Online Store is concluded for an indefinite period and does not entail any financial obligations for the Buyer.
The contract may be terminated at any time by deleting the Account in the Online Store or sending information about the Buyer’s resignation to the Seller’s e-mail address: kontakt@greenspot.pl
Promotions for selected Products from the store’s offer may be organized in the Online Store.
The Seller decides about the rules regarding the promotion, making them public on the Online Store website.
2. CONDITIONS FOR PLACING AN ORDER
The Buyer is obliged to use the Online Store in a manner consistent with applicable law, principles of social coexistence and morality, bearing in mind the respect for personal rights and intellectual property rights of third parties.
The online store sells on the territory of the Republic of Poland.
The buyer may choose one of the following methods of placing an order:
a) placing an order by completing the order form available on the Store’s website,
b) placing an order by e-mail,
All products available in the online store are original, free from defects, and in accordance with applicable standards and requirements.
Orders can be placed 7 days a week, 24 hours a day.
A necessary condition for the successful submission and execution of the Order referred to in point a) is adding the Product to the Basket, filling the Order Form available on the Store’s website by the Buyer and sending it to the online store.
A necessary condition for the effective submission and implementation of the Order referred to in point b) is the sending of personal data, contact details and the name of the selected product by the buyer to the following address: zamowania@greenspot.pl
Orders placed on weekdays after 5:00 p.m. and on Saturdays, Sundays and public holidays will be processed on the next business day.
Confirmation of placing the order and accepting the order for implementation will be sent to the Buyer by the Seller in the form of an e-mail.
The sales contract is considered concluded when the Buyer receives the e-mail referred to in point 12.
Orders submitted for implementation may be canceled by the Buyer who is also a Consumer within the meaning of the Act of 23rd April 1964 – Civil Code (Journal of Laws 1964 No. 16, item 93, as amended), until the Product is shipped.
The order fulfillment cycle time (completing the order and preparing for shipment) is up to 48 hours.
The given time of order fulfillment does not include the time of delivery. In the case of a product whose availability is 24h, shipment takes place immediately after placing the order and paying for it.
The Buyer is informed about the unavailability of Products, and therefore may consent to the extension of the Order fulfillment cycle time or cancel the ordered Product or the entire Order. If the Products are not available, the estimated time of Order fulfillment is determined individually with the Buyer, and it is on average up to 14 business days.
The Seller reserves the right to cancel the Order if the Buyer, despite being requested, has not completed the deficiencies required for the effective implementation of the Order within 7 days.
3. PAYMENT

4. DELIVERY
The Buyer may choose the following methods of receiving the ordered Products:
personal pickup of ordered Products after prior consultation with the Seller;
delivery of the Products to the Buyer’s address by the DHL courier company, cash on delivery;
delivery of the Products to the Buyer’s address by the DPL courier company after paying for the order in advance;
The delivery address is provided by the Buyer when placing the Order.
Delivery costs are paid by the Buyer, unless there was a free shipping promotion during the order.
The Seller undertakes to cover the shipping costs within the territory of Poland, if the above has been specified in the Product description.
Shipping costs are calculated in accordance with the current price lists and depend on the weight and size of the shipment. The buyer is informed about the shipping costs when placing the order.
The Seller undertakes to provide the Buyer with Products free from defects.
The buyer undertakes to pick up the Product shipped.
5. COMPLAINTS

6. EXCHANGE
The customer has the right to replace the product with a different model, color or pattern. The condition for the exchange is to return the new, undamaged and well-secured product to the store’s address:

The Buyer is entitled to the exchange within 14 days from the date of receipt of the goods. The buyer replaces the product at his own expense. The cost of shipping a new product in the case of receiving a previously damaged product is covered by the Seller.
7. WARRANTY
Products offered in the Online Store are covered by a warranty provided by the Seller.
The warranty period and the details of the warranty procedure are specified in the warranty card attached to the Product.
The warranty is valid provided that the assembly and the use of the product comply with the manufacturer’s recommendations contained in the manual attached to the product.
The warranty does not exclude, limit or suspend the Buyer’s rights under the Seller’s liability for physical defects of the Product to the extent specified by the Act of 23 April 1964 – Civil Code (Journal of Laws 1964 No. 16, item 93, as amended).

9. PROTECTION OF PERSONAL DATA

10. PROTECTION OF COPYRIGHT
All photos of the Products and other materials (including texts, graphics, logos) posted on the website of the Online Store https://greenspot.pl are the property of the Seller or have been used by the Seller with the consent of third parties who own their copyrights.
It is forbidden to copy photos and other graphic materials as well as reprint texts posted on the website of the Online Store https://greenspot.pl, including their sharing on the Internet without the written consent of the Seller or other third party who owns the copyright.
External entities are also forbidden to download photos from the website of the Online Store https://greenspot.pl and use them for marketing and commercial purposes.
The use of the above-mentioned materials without the written consent of the Seller or another third party who is entitled to copyrights is illegal and may constitute the basis for initiating civil and criminal proceedings against the perpetrators of this practice.
11. LIABILITY
The Seller is liable for damage caused to the Buyer due to non-performance or improper performance of the Agreement, unless the failure to perform or improper performance of the Agreement is a consequence of circumstances for which the Seller is not responsible.
The Seller’s liability for damage, and thus the amount of the Buyer’s claim, may not exceed the value of the purchased Product, in connection with which the damage occurred. The above does not apply to Buyers who are consumers within the meaning of the Act of 23 April 1964 – Civil Code (Journal of Laws No. 16, item 93, as amended).
The seller is not responsible for any damage caused, inter alia, as a result:
damage resulting from improper use, assembly, reconfiguration, maintenance, storage or transport;
damage resulting from failure to comply with common rules, use of the Product inconsistently with its intended purpose and other damage caused by the fault or ignorance of the Buyer;
mechanical damage and the resulting defects;
Force Majeure, i.e. unforeseeable and preventable random events, e.g. hurricane, flood, fire, etc.
The Buyer is responsible for any damage caused as a result of the Buyer’s breach of the provisions of these Regulations or the provisions of generally applicable law.
The Seller shall not be liable towards the Buyer for any damage (damnum emergens) and lost profits (lucrum cessans), and the Seller is not obliged to pay any compensation claims to the Buyer.
The above does not apply to Buyers who are consumers within the meaning of the Act of 23 April 1964 – Civil Code (Journal of Laws No. 16, item 93, as amended).
The seller is not responsible for the correct operation of the transaction systems provided by PayU, Imoje and all other transaction systems available in the Greenspot store.
All claims related to the implementation of transactions supported by online payments should be addressed to the companies operating the payment system.
12. FINAL PROVISIONS
The Seller reserves the right to introduce restrictions on the use of the Online Store caused by its technical service, maintenance work or works on improving its functionality. At the same time, the Seller undertakes to make every effort to ensure that the above-mentioned inconveniences take place at night and last as short as possible.
The Seller reserves the right to amend the Regulations. The changes come into force at the time clearly indicated by the Seller, but not earlier than 7 days from their announcement.
Orders placed before the changes referred to in the previous sentence enter into force, will be implemented on the terms applicable at the time of their submission.
Returns of Products in the event of a warranty or complaint procedure or in connection with withdrawal from the contract, sent at the expense of the Seller or cash on delivery, will not be accepted.
Any disputes between the Parties will be settled amicably or in the presence of an independent and impartial mediator. However, if it is not possible to settle the dispute amicably, including through mediation, the court competent to resolve the dispute will be the court competent for the seat of the Seller.
The provision of point 4 of this paragraph does not apply to Buyers who are consumers within the meaning of the Act of 23rd April 1964 – Civil Code (Journal of Laws No. 16, item 93, as amended), for which the jurisdiction of the Court will be determined according to generally applicable provisions in the Republic of Poland.
In matters not covered by these Regulations, the relevant provisions of Polish law shall apply, in particular the Act of April 23rd, 1964 – Civil Code (Journal of Laws 1964 No. 16, item 93, as amended) and the Act of May 30th, 2014 on consumer rights (Journal of Laws of 2014, item 827) and other relevant.
